2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.
3. As per the prosecution case, on 11.11.2022 at 08:00 A.M., informant got information that his son hanged
Patna High Court CR. MISC. No.46976 of 2023(3) dt.05-09-2023 2/3 himself in his room. On the basis of this information, informant and his family members reached at the place of occurrence and found that his son was dead. It is further alleged that this petitioner along with other co-accused persons had murdered his son.
4. It is submitted that petitioner is innocent and has falsely been implicated in this case. Petitioner has been made accused in this case only on the basis of mere suspicion. Petitioner runs a tyre puncher shop for his livelihood and reside in a lodge on rent. The petitioner has no concern with the deceased or accused person. There is no direct or indirect material to show his complicity to this case. Petitioner claims clean incident.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Gaya, in connection with Rampur P.S. Case No. 615 of 2022, subject to the
Patna High Court CR. MISC. No.46976 of 2023(3) dt.05-09-2023 3/3 conditions laid down under section 438(2) of the Code of Criminal Procedure.
