The petitioner apprehends his arrest in Begusarai Town P.S. Case No. 177/2016, registered for the offences punishable under Sections 306 and 304B of the Indian Penal Code. The mother of the deceased alleged that her daughter committed suicide on 29.03.2016, but her (informant) mental condition was not good and therefore, she could not disclose the truth. She further stated that Sandeep Kumar, resident of Hathsarganj, Hajipur, Vaishali assured her daughter to marry and he was blackmailing her daughter. The victim was also willing to marry with the boy, but when she talked with the boy he demanded dowry that is why her daughter committed suicide. Learned counsel for the petitioner submits that on
Patna High Court Cr.Misc. No.31877 of 2016 (3) dt.22-09-2016 2/2 29.03.2016 itself Rajendra Choudhary father of the victim made statement that he found his daughter hanging from the ceiling fan. On the basis of statement of father of the victim Town (Ratanpur O.P.) U.D. Case no. 03/2016 was registered. After eighteen days of the occurrence, the mother of the deceased filed this case.
Considering the facts aforesaid and the fact that the father did not make any sorts of allegation on the day on which his daughter committed suicide, but the mother made allegation against the petitioner after eighteen days of occurrence that the petitioner refused to marry with her daughter and that is why she committed suicide, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 177/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
