The petitioner seeks bail in Doriganj P.S. Case No. 100 of 2021, registered for the offence under Section 401, 379, 411 of the Indian Penal Code.

As per the F.I.R., petitioner was apprehended with stolen motorcycle.

It is submitted on behalf of petitioner that the alleged motorcycle belongs to one Upendra Rai, but no case under Section 379 of the I.P.C. for theft of the said motorcycle is pending. Petitioner is in custody since 12.05.2021. It is further submitted that it is an error of record in the impugned order, wherein it is stated that petitioner has criminal antecedent, but as a matter of fact, the petitioner has got clean antecedent. Learned A.P.P. for the State has opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-XIII, Chapra, District Saran in connection with Doriganj P.S. Case No. 100 of 2021.
