====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 22-07-2026 At the outset, learned counsel appearing on behalf of the petitioners seeks to withdraw the prayer for bail on behalf of
Patna High Court CR. MISC. No.46834 of 2026(2) dt.22-07-2026 2/3 petitioner no.3 Sri Charan Paswan submitting that the petitioner no.3 has been arrested during the pendency of the bail application.
2. In view of the above, the prayer for bail on behalf of petitioner no.3 Sri Charan Paswan stands dismissed as withdrawn.
3. Heard learned counsel appearing on behalf of the petitioners and learned APP for the State.
4. The petitioners seek pre-arrest bail in connection with Sarsi P.S. Case No. 48 of 2026 registered for the offence punishable under Sections 191(2), 126(2), 115(2), 76, 352, 351(2), 351(3) and 190 of the BNS.
5. As per the allegation made in the F.I.R., the accused persons including the petitioners with an intention to kill assaulted the informant causing her injury on head and other parts of the body.
6. Learned counsel appearing on behalf of the petitioners submitted that the petitioners are innocent and they have committed no offence as alleged in the F.I.R. Both the parties are agnates and there is land dispute between them. The injury sustained by the victim is simple in nature.
7. Learned APP for the State has vehemently opposed
Patna High Court CR. MISC. No.46834 of 2026(2) dt.22-07-2026 3/3 the prayer for grant of pre-arrest bail to the petitioners.

Having heard the rival submissions made on behalf of the parties, as well as, having perused the allegation made in the F.I.R. and the fact that the injury sustained by the informant is simple in nature, the petitioner nos. 1, 2, 4, 5, 6, 7, 8, 9, 10 and 11, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, First Class, Purnea in connection with Sarsi P.S. Case No. 48 of 2026, subject to the condition as laid down under Section 438(2) Cr.P.C / 482(2) BNSS.
9. The District Court is directed to verify the criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases as what has been stated in Para-3 of the bail petition, this order will automatically lose its force.
10. The bail application stands disposed of.
