The petitioner is apprehending his arrest in connection with Araria (Bairgachhi O.P.) P.S.Case No.526 of 2015 dated 12.10.2015 , registered for offences punishable under Sections 341, 323, 325, 307, 379, 504, 506/34 of the Indian Penal Code. Prosecution story as per the FIR is that the petitioner and others came variously armed and the petitioner was also armed with lathi and there is allegation against the other accused persons that they assaulted by Farsa causing injury to three persons.

Submission of the learned counsel for the petitioner is that there is case and counter case and there is no allegation of

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-V, Araria in connection with Araria P.S. (Bairgachhi O.P.) Case No.526/2015 dated 12.10.2015, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid direction, this application is allowed.
