JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 08-06-2015 The petitioners apprehend their arrest in relation to Ishakchak P.S. Case No. 34 of 2015 corresponding to G.R. No. 893/2015 registered under Sections 366, 120(B)/34 of the Indian Penal Code as well as Section 66 of I.T. Act, pending before Sri N. Dayal, Judicial Magistrate, Bhagalpur.

Having perused the statement of victim girl under Section 164 of the Code of Criminal Procedure, I am not inclined to entertain this application. Accordingly, this application is dismissed.

However, petitioners may surrender before the court below and seek regular bail where their prayer may be considered on its own merit without being prejudiced by the order of this Court.
