JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 272 and 273 of the Indian Penal Code and section 47(a) of Excise Act. It is alleged that from the fertilizer shop of the petitioner 30 sachets of 400 ml country made liquor were recovered.

It is submitted by learned counsel for the petitioner the seizure has not been made from the possession of the petitioner. Considering the quantity of recovery, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Patory P.S. Case No. 73 of 2015 pending in the

Patna High Court Cr.Misc. No.22396 of 2015 (2) dt.06-07-2015 2/2 court of learned C.J.M., Samastipur.

This application is disposed of with the aforesaid observation/direction.
