JUSTICE BIRENDRA KUMAR ORAL ORDER 17-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-B)a, 26/35 of the Arms Act.

The named of the petitioner has transpired in the confessional statement of the co-accused persons before the police.

Allegation is that the accused persons were making preparation to commit dacoity. The petitioner has stated on oath that he has no criminal antecedent.

Considering the aforesaid facts and circumstances, let

Patna High Court Cr.Misc. No.3768 of 2017 (2) dt.17-02-2017 2/2 the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 8th Additional Sessions Judge, Muzaffarpur/ Successor Court in connection with Kanti Police Station Case No108 of 2016, G.R. No. 496 of 2016, S.Tr. No. 617 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
