2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 149, 148, 341 , 323 , 324, 307, 325 , 354 A , 379, 504 and 506 of the Indian Penal Code .

As per the prosecution case , on the alleged date and time of occurrence , these petitioners along with other coaccused persons came at the field of the informant and assaulted the informant and others due to which four persons sustained injury .

4. It is submitted on behalf of the petitioners that there was a land dispute between the parties and on the alleged date and time of occurrence , prosecution party forcibly tried to capture the land due to which a simple occurrence of mararpeet took place between the parties in which both sides sustained injury . Case and counter case . Allegation of assault is general and omnibus and there is no specific overt act is alleged against these petitioners. Similarly situated co-accused persons have already granted bail by this Court vide order dated 09.09.2024 in Cr. Misc. No. 46525 of 2024 . Petitioners claim clean antecedent.

5 . Learned counsel for the State oppose the bail petition .

6 Considering the fact that allegation of assault is general and omnibus against these petitioners , clean antecedent of the petitioners and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let

No.48682 of 2024(4) dt.10-01-2025 3/3 the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM VI Danapur in connection with Naubatpur P.S. Case No. 179 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
