Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 47(a) of the Excise Act.

Near the house of co-accused Pramod Kumar Yadav and Hira Yadav and from a magic van 245 litres of country made liquor were recovered. The petitioner is alleged to be the driver of the alleged van.

It is submitted by learned counsel for the petitioner that petitioner does not claim the seized country made liquor.

A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one.

No.24024 of 2015 (2) dt.10-07-2015 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Excise Case No. 03 of 2015, pending in the Court of learned Chief Judicial Magistrate, Motihari, East Champaran. With the observations above, the application stands disposed off.
