The petitioner is in custody since 18.10.2022 in connection with Kajraili P.S. Case No. 73 of 2022 registered for the offence punishable under Sections 302/201/120(B)/34 of the Indian Penal Code.

As per the prosecution case, for the killing of the deceased, the petitioner and other co-accused have been named in the F.I.R.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due to enmity. It is further submitted that the father of the petitioner has not taken any loan as alleged in the F.I.R. The petitioner has no criminal antecedent.

He submits that during investigation, the petitioner has confessed that the deceased wanted to have sexual relationship with her though she is a married lady who used to oppose the same and because of that he has been killed by her.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, 16, Bhagalpur in connection with Kajraili P.S.
