The petitioners seek bail in anticipation of their arrest in connection with Ishipur (Bara hatt) P.S. Case No. 26 of 2020 instituted for the offence under Sections 188, 267, 272, 147, 148, 149, 141, 323, 448, 353, 307, 427, 333, 337 and 379 of the Indian Penal Code.
The accusation in the First Information Report is that when the police party forbade the persons from
Patna High Court CR. MISC. No.41137 of 2020(2) dt.24-07-2021 2/3 assembling at the house of one Pankaj Ravidas in big number and asked them to disperse because of the Corona protocol, the police party was attacked and two of the police men have received injuries.
The learned counsel for the petitioners has submitted that assuming but not admitting every allegation in the F.I.R. to be true, they have not been attributed with any overt act. Learned counsel for the petitioners further submits that the petitioners have been named in this case only because of their showing support with such persons who were ill treated by the police. Considering this fact, aforesaid Pankaj Ravidas has been granted bail by the court below. Regard being had to the afore-stated facts and taking into account that petitioners are amongst twenty seven named accused persons along with 120 unnamed with no specific overt act attributed against them, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten
