====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-06-2021 Heard Mr. Amrendra Kumar Singh, the learned Advocate for the petitioners and Ms. Indu Kumari Srivasatava, the learned APP for the State.
The petitioners seek bail in anticipation of their arrest in connection with Parasbigha P. S. Case No.154 of 2017, instituted for the offences under Sections 448, 341, 323, 354, 427, 379 and 34 of the Indian Penal Code.
It has been submitted on behalf of the petitioners
Patna High Court CR. MISC. No.787 of 2021(2) dt.25-06-2021 2/2 that after lodging of the case, the petitioners were granted police bail and they have not misused the privilege of police bail till date.
It has further been submitted that there is a counterversion of the occurrence also and the accusation of assault and theft is absolutely incorrect.
Regarding being had to the circumstances of this case and the fact that the petitioners are on police bail, the present petition is disposed off with a direction that in case the petitioners surrender before the Court below, the Court below shall take into account all the facts noted above including that the petitioners were on police bail and have not misused the privilege of bail and shall pass orders in accordance with law, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court. With the aforesaid direction/ observation this application stands disposed off.
