JUSTICE BIBEK CHAUDHURI ORAL ORDER 27-08-2024 The petitioners are accused persons in connection with Complaint Case No. 3145 of 2013 filed by the Opposite Party No. 2 under Section 498A of the IPC read with Section 3/4 of Dowry Prohibition Act.
2. It is submitted by the learned Advocate for the petitioners that the dispute between the petitioners and the Opposite Party No. 2 has been amicably settled on payment of permanent maintenance to the Opposite Party No. 2.
3. By filing an interlocutory application, the petitioners have filed the receipt of payment of Rs. 2 lakhs to
Patna High Court CR. MISC. No.25908 of 2015(13) dt.27-08-2024 2/2 the Opposite Party No. 2.
4. He submitted that the Opposite Party No. 2 is not interested to proceed with the above-mentioned complaint case on receipt of the settlement amount.
5. As the Opposite Party No. 2 remains absent and the materials on record suggest that she has already received a sum of Rs. 2 lakhs as permanent maintenance or alimony, the Complaint Case No. 3145 of 2013 pending against the petitioners be quashed.
