The petitioner apprehends his arrest in Mahila P. S. Case No. 159 of 2016 registered for the offences under Sections 498A, 494, 379, 337, 323, 341, 504 and 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. Learned counsel for the petitioner submits that the marriage of the petitioner with the informant was solemnized in the year 2004. The informant firstly filed complaint case no. 562 of 2006 under sections 498A and 406 of the Indian Penal Code and again lodged Sarmera P.S. Case No. 87 of 2008 on 07.12.2008 in which the petitioner is on bail. The informant is in

Patna High Court Cr.Misc. No.12708 of 2017 (2) dt.10-04-2017 2/2 habit of filing such cases against the petitioner. The informant again filed a complaint petition, on the basis of which, present FIR was lodged.

Considering the facts aforesaid and that the marriage of the informant was solemnized with the petitioner in the year 2004, the informant firstly lodged complaint case in the year 2006 and thereafter the informant lodged second case against the petitioner in Sarmera P.S. Case No. 87 of 2008 for demand of dowry and torture, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Nalanda at Biharsharif in Mahila P. S. Case No. 159 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
