The petitioners apprehend their arrest in Rajepur P.S. Case No. 81/2016, instituted for the offences punishable under Sections 143, 144, 145, 147, 148, 149, 151, 152, 153A, 160, 295,
Patna High Court Cr.Misc. No.35688 of 2018 (3) dt.06-08-2018 2/2 295A, 297, 298, 395, 341, 323, 504, 342 and 504 of the Indian Penal Code.
Learned counsel for the petitioners has submitted that the petitioners are not named in the written report. Name of these petitioners has come in the supervision note of the Dy. S.P., Pakarideyal.
It is alleged in written report that on date of occurrence 350-400 persons armed with weapon came at shop of informant calling ante-Muslim slogan and looted articles of shop. The informant took name of two accused persons Shiv Sah and Jailal Ram in F.I.R.
Considering the aforesaid facts and circumstances of the case, provisional bail earlier granted to the petitioners, above named, by a Co-ordinate Bench of this Court vide order dated 29.06.2018 is hereby confirmed. The petitioners will be allowed to remain on same bail bond as furnished earlier in compliance of order dated 29.06.2018.
