Petitioner is in custody in connection with Chakiya P.S. Case No. 327/2018 for the offence under sections 395 and 397 of the Indian Penal Code.

Learned counsel for the petitioner would submit that petitioner was not named in the FIR. The informant has lodged the FIR accusing that 25 to 30 dacoits entered into his house by breaking door and they looted cash and ornaments by assaulting the informant and his wife.

Learned counsel for the petitioner submits that petitioner is in custody since 22.12.2018 yet he has not been put on TIP in a case in which petitioner was not named in the FIR. Considering the aforesaid, the Court is inclined to
