The petitioner apprehends his arrest in connection with Hathauri P.S. Case No. 235 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further he submits that petitioner has been living separately from his brother since more than a decade and the rooms from where the alleged recovery has been made does not belong to the petitioner rather it is in the share of his brother. It is also submitted that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the

Patna High Court CR. MISC. No.56029 of 2021(2) dt.11-04-2022 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Special Judge, Excise, Muzaffarpur in connection with Hathauri P.S. Case No. 235 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
