JUSTICE SUDHIR SINGH ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 420, 120(B) and 467 of the Indian Penal Code.

The allegation against the petitioner is that he executed a sale deed in favour of complainant's wife which land is not belonging to Ritesh Anupam or Archana Anupam. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The matter is of civil nature. It is further submitted that other co-accused has been granted anticipatory bail, vide order dated 25.03.2015 in Cr.Misc. No.39943 of 2014. The present prosecution has been brought after a lapse of six years. It is further submitted that the petitioner

Patna High Court Cr.Misc. No.28360 of 2015 (3) dt.01-10-2015 2/2 is ready to deposit an amount of Rs. 30,000/- (thirty thousand) in the court below, which shall be subject to final disposal of the case.

On behalf of the State and counsel for the complainant it has been submitted that the petitioner is named in the complaint case and there is specific allegation against him. Considering the aforesaid facts, the petitioner is directed to deposit an amount of Rs. 30,000/-(thirty thousand) in the court below, which shall be subject to final disposal of the case.

Let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Suvash Kr.Roy, learned J.M., 1st Class, Muzaffarpur, District- Muzaffarpur in connection with C.R.No, 520 of 2013, subject to the conditions as laid down u/s 438(2) Cr.P.C.
