JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 02-02-2023 The petitioner, who is the husband of the Opposite Party No. 2, seeks quashing of the order dated 30.04.2019 passed by the Sub-Divisional Judicial Magistrate, Saran at Chapra in connection with Complaint Case No. 3784 of 2015/Trial No. 1652 of 2019, by which the petition for discharge has been rejected.

Heard the learned counsel for the petitioner as well as the learned counsel for the complainant.

There was matrimonial dispute between the couple, but it has amicably been resolved. They are living together in cordial atmosphere. The couple are present in court. They do not made any type of allegation against each other.

Patna High Court CR. MISC. No.44863 of 2019(4) dt.02-02-2023 2/2 Considering the above-mentioned facts and circumstances, the order dated 30.04.2019 passed by SubDivisional Judicial Magistrate, Saran at Chhapra in Cr. Misc. No. 3784 of 2015 is set-aside.

Needless to say, if the husband or his family members inflict atrocities, the complainant would be at liberty to take the recourse of law.
