The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 409 of the Indian Penal Code.
The petitioner allegedly did not send the papers of teacher's appointment to the authority concerned on demand. Submission of the petitioner is that the petitioner is a government servant and was working as Panchayat Secretary. At that time the act of the petitioner may be alleged at best the act of insubordination of government servant for which departmental proceeding is there. No criminal case is made out against the petitioner.
Considering the aforesaid facts, let the petitioner,
Patna High Court Cr.Misc. No.53791 of 2016 (2) dt.14-12-2016 2/2 above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri (Rohtas)/Successor Court in connection with Akorhi Gola Police Station Case No.15 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
