2. The petitioner seeks bail in connection with Excise P.S. Case No. 1147 of 2023 registered for the offence under Sections 30(a) of the Bihar Prohibition and Excise (Amended) Act, 2018.

3. As per the prosecution case, 60 liters of country made wine has been recovered from the premises of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 21.06.2023, he is quite innocent and has not committed any offence.

5. Learned A.P.P. has vehemently opposed the

Patna High Court CR. MISC. No.45934 of 2023(2) dt.04-08-2023 2/2 prayer for bail.

6. Considering the recovery of liquor, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Court No. 3, Gaya/concerned Court below in connection with Excise P.S. Case No. 1147 of 2023.
