JUSTICE SUDHIR SINGH ORAL ORDER 28-07-2015 Heard learned counsel for the petitioners and the State. The petitioner are apprehending his arrest in a case instituted under Sections 193.419, 420, 467, 438 and 471 of the Indian Penal Code.
The prosecution story, in brief, is that the complainant has purchased the land and constructed the house. It is alleged that the accused persons in collusion with each other executed sale deed in favour of one Ashok Kumar Paswan who executed the sale deed in personating himself as Ram Subhan Das all though his name is different and the accused persons have
Patna High Court Cr.Misc. No.29263 of 2015 (2) dt.28-07-2015 2/2 committed forgery in executing the sale deed. On behalf of the petitioners, it has been submitted that the petitioners have got no criminal antecedent. From perusal of FIR it appears that the matter relates to civil dispute. It is further submitted that the petitioners have been made accused due to mistake of fact. The present occurrence is said to have taken place due to land dispute.
On behalf of the State, it has been submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Rosera, District- Samastipur in connection with Rosera P.S.Case No. 302/2012, subject to the conditions as laid down u/s 438(2) Cr.P.C.
