The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,324 and 307/34 of the Indian Penal Code, section 27 of the Arms Act and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
It is alleged that on the order of this petitioner, co accused Anil Singh caused knife injury to the informant and the accused persons abused the informant by calling the caste name. It is submitted by the learned counsel for the petitioner that the overt act has not been alleged against the petitioner and for the occurrence of 3.5.2014 at 8 P.M. the FIR was registered on 4.5.2014 at 3 P.M. It is further submitted that
Patna High Court Cr.Misc. No.34140 of 2015 (2) dt.14-08-2015 2/2 the petitioner is handicapped. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the fact that the accusation of assault is not levelled against the petitioner, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Bahadurpur P.S. Case No. 130 of 2014 pending in the court of learned CJM, Darbhanga.
This application is disposed of with the aforesaid observation/direction.
