2. The petitioner, who retired as Revenue

Patna High Court CWJC No.10083 of 2023 dt.01-05-2024 2/3 Kramchari on attaining the age of superannuation on 30.09.2019 from the Office of Circle Officer, Shankarpur, District- Madhepura, has filed this writ petition praying for payment of post retirement benefits of the petitioner.

3. Learned counsel for the petitioner has submitted that all post retirement benefits have been paid except pension.

4. Mr. Arif Daula Siddiqui, learned counsel representing the respondent nos. 1, 2, 4 and 5 submits that the pension of the petitioner could not be paid as the service book of the petitioner was not available in the office of the respondent no.5- the Circle Officer, Shankarpur Block, Madhepura. He, however, has submitted that the pension of the petitioner shall be paid within a period of four weeks from today after reconstruction of the service book of the petitioner.

5. In view of the submission made by Mr. Arif Daula Siddiqui, learned counsel representing the respondent nos. 1, 2, 4 and 5, this writ petition is hereby disposed of with a direction to the respondents, more particularly to the respondent no.5, to pay the pension of the petitioner within

6. The writ petition is disposed of with the above directions.
