JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 16-02-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends her arrest in connection with Nautan P.S. Case No. 158 of 2016 registered for the offences punishable under sections 304B, 201 and 120B of the Indian Penal Code.
Chanda Devi, daughter of the informant, was married to Sunil Sharma on 01.07.2016 and thereafter, he started demanding gold chain and also on telephonically demanded the same from the informant and failing which caused threats to kill Chanda Devi. Thereafter, Santosh Sharma, the father-in-law of the deceased informed the informant telephonically that she has died and it is alleged that for not fulfilling the demand of gold chain, the husband, father-in-law, motherin-law and Nanad have killed the victim and cremated her dead body.
Patna High Court Cr.Misc. No.3892 of 2017 (2) dt.16-02-2017 Submission is of false implication and that the petitioner is old mother-in-law aged about 62 years, she is living separately with the husband of the deceased and her husband having no concern with the family of deceased husband. There is no specific allegation against the petitioner. The allegations are omnibus and general in nature. Father-in-law has already been allowed regular bail and the husband is in custody.
The learned A.P.P. submits that against the petitioner also there is a general allegation.
In the facts and circumstances as stated above, considering that there is a general allegation and as such, the petitioner, above named, in case of her arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Nautan P.S. Case No. 158 of 2016, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
