JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-12-2016 Heard the learned counsel for the petitioner and the learned A.P.P. representing the State.

The petitioner seeks anticipatory bail in connection with Pipra P.S. Case No. 211 of 2015 registered for the offences punishable under Sections 354(D), 341, 323, 325, 307, 379, 504 and 506/34 of the Indian Penal Code.

The petitioner is not named in the F.I.R., but during investigation, his name transpired.

Submission is of false implication and that the informant has filed compromise petition alleging innocence of the petitioner vide Annexure-2. The police have wrongly implicated the petitioner in this case. Though, he has got no

Patna High Court Cr.Misc. No.47526 of 2016 (2) dt.14-12-2016 2/2 concern with the said occurrence and, as such, the petitioner deserves sympathetic consideration.

Learned A.P.P. submits that now, the informant has compromised the case with the petitioner.

In the facts and circumstances stated above, considering the compromise arrived at between the petitioner and the informant, now, the petitioner in case of his arrest or surrender before the court below within one month from the date of receipt / production of a copy of this order shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Pipra P.S. Case No. 211 of 2015, subject to the conditions as laid down in Section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J) ajaypd./- U T
