JUSTICE BIRENDRA KUMAR ORAL ORDER 13-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code. Allegation against the petitioner is that she got job of a Panchayat Teacher by producing a forged certificate. The petitioner is ready to deposit the remuneration, if any, received as Panchayat Teacher. Further submission is that the produced certificate is a genuine one and it is still to be established that it was a forged document.

Considering the aforesaid fact, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of thirty days from the date of receipt

Patna High Court Cr.Misc. No.17435 of 2017 (2) dt.13-04-2017 2/2 of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Arwal/successor Court in connection with Banshi Police Station Case No. 05 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner would deposit the entire remuneration received by her as Panchayat Teacher within four weeks and shall report to the learned court below, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner and also condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
