The petitioner apprehends his arrest in Sabour (Goradih) P.S. Case No. 137/2016, registered for the offences punishable under Sections 409, 419 and 420 of the Indian Penal Code.
The petitioner being Chairman of the PACS purchased 2077.40 Quintals of paddy. The petitioner had to deliver 1391.86 Quintals of C.M.R. by the end of 30.06.2016, but petitioner only delivered 776.60 Quintals of C.M.R. to the B.S.F.C., 615.26 Quintals is still lying due against the petitioner. Mr. Radha Mohan Singh learned counsel for the
Patna High Court Cr.Misc. No.18144 of 2017 (2) dt.16-05-2017 2/2 petitioner submits that the petitioner is ready to deposit the entire amount i.e. Rs. 14,06,484.36 within six months from today. Mr. Shailendra Kumar Singh learned counsel for the B.S.F.C. submits that the B.S.F.C. is only to get back the money. Considering the facts aforesaid and the fact that the petitioner is ready to deposit the entire amount in four installments within six months, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sabour (Bhagalpur) in connection with Sabour (Goradih) P.S. Case No. 137/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
If the petitioner fails to deposit any installment within six months from today, the learned court below shall cancel the bail bond of the petitioner forthwith.
