The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 328, 302, 201, 504, 506/34 of the Indian Penal Code.

Earlier the prayer for grant of anticipatory bail of the petitioner was withdrawn vide order dated 08.12.2022 passed in Cr. Misc. No. 48659 of 2022. It is a case of commission of murder of the daughter of the informant by all the F.I.R named

Patna High Court CR. MISC. No.49971 of 2023(2) dt.02-08-2023 2/3 accused persons including the petitioner for nonfulfillment of dowry demand. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is uncle of the husband of the deceased and he had no concern with the day-to-day affairs of the deceased and her husband. There is general and omnibus allegation against the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Moreover, other similarly situated co-accused have been granted anticipatory bail by a coordinate Bench of this Court vide order dated 03.04.2023 passed in Cr. Misc. No. 48659 of 2022.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid, let the petitioner, above named, be released on anticipatory bail

Patna High Court CR. MISC. No.49971 of 2023(2) dt.02-08-2023 3/3 in the event of his arrest or surrender before learned Court below within a period of four week from today and on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Araria in connection with Bhargama P.S. Case No. 129 of 2021.
