JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-10-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323, 376, 406, 384, 386 and 387 of the Indian Penal Code.
The prosecution case is that the petitioner, being the neighbour of the informant Rita Devi, after administering some intoxicant through cold-drink established physical relationship with the informant and took her obscene photographs, thereafter the petitioner continued to establish physical relationship with her. When the husband of the informant returned from Surat, his place of working, the informant disclosed the incident to her husband. Thereafter, her husband enquired about the incident whereupon the petitioner demanded `3 lakhs as extortion otherwise threaten to make public obscene photograph of the informant. The
Patna High Court Cr.Misc. No.45928 of 2016 (2) dt.22-10-2016 2/2 petitioner also misappropriated jewellery and other articles of the informant.
It is submitted by the learned counsel for the petitioner that for the petty dispute, the accusation has been levelled. The informant subsequently retracted from her initial version and filed a petition to that effect before the learned court below. The aforesaid facts constitute ground for consideration of bail.
Let the learned court below consider the prayer for bail of the petitioner if he surrenders within a period of six weeks in connection with Sidhwalia P.S. Case No. 57 of 2016 pending in the court of learned CJM, Gopalganj.
Accordingly, the application is disposed of.
