JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-08-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 307, 323, 341, 342, 379, 34 of the Indian Penal Code. It is alleged that co-accused Murari Mandal assaulted with iron rod on the head of the informant and when the informant fell down then these petitioners assaulted by means of lathi.

It is submitted by learned counsel for the petitioners that the case lodged by the petitioners' side is at earlier point of time and out of the three injuries one injury on the head of the informant has been found to be grievous which is alleged to have been caused by co accused Murari Mandal who has been granted anticipatory bail by learned Court below vide A.B.P. No. 571 of 2015. Moreover there is counter version of the occurrence also and petitioners' side also received injuries.

A statement has been made in para 3 of the

Patna High Court Cr.Misc. No.31514 of 2015 (2) dt.05-08-2015 2/2 petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamui in connection with Khaira P.S. Case No. 45 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
