The petitioner seeks bail in Sakra P.S. Case No. 265 of 2021, registered for the offence punishable under Sections 379, 420 and other allied sections of the Indian Penal Code, section 7 of the Essential Commodities Act, and section 51-60 of the Disaster Management Act.
On secret information that some miscreants are involved in black marketing of Covide-19 kits and other materials, a raid was conducted and from house of this petitioner 40 pieces of Covid-19 kit , PPE kit-10 pcs., Swab-7 packet, mask 2 packet- 7 pieces, disposable syringe 60 pieces,
Patna High Court CR. MISC. No.58417 of 2021(2) dt.04-02-2022 2/2 cotton 7 piece, gloves 2 packet, dettol soap 30 pieces, Dr Morepan Ala one piece and 11 pieces of Sanitizer were recovered.
It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. The alleged seizure list is forged and fabricated as from perusal of seizure list it would appear that in column-2 the date 10.05.2021 has been manipulated by 09.05.2021. Similarly situated accused Deepak Kumar has already been granted bail by this court vide order dated 07.12.2021 passed in Cr. Misc. No. 56481/2021. Petitioner claims clean antecedent and he is in custody since 11.05.2021 and investigation in this case is complete. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, East Muzaffarpur in connection with Sakra P.S.
