The petitioner apprehends his arrest in connection with Salkhua P.S. (Banma Itahri O.P.) Case No. 155 of 2016, registered for the offences punishable under Section 7 of Essential Commodities Act.
Allegedly, 14 bags rice total 5 quintal 43 Kgs. was found kept in under construction house of the petitioner and villagers told that the rice was kept by one woman after purchasing the same and thereafter the said rice was kept in a room of Middle School, Makdhumpur, and was sealed. Submission is of false implication and that Nilam Devi has purchased the said rice and has kept the same. The petitioner has got no concern with the said rice, the house is under
Patna High Court Cr.Misc. No.7715 of 2017 (2) dt.01-03-2017 2/2 construction and open one where Nilam Devi kept the same and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. submits that the petitioner is named in the F.I.R.
In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Saharsa, in connection with Salkhua P.S. (Banma Itahri O.P.) Case No. 155 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
