2. The petitioner seeks regular bail in connection with Town P.S. Case No. 70 of 2025 registered for the offence under Sections 8(c), 21(c), 29 and 35 of the NDPS Act.

3. It is alleged that 76 tablets of Pyeevon Spas Plus from the left pocket of pant and 2 syrup of Onerex has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 10.04.2025. The petitioner has one criminal antecedent i.e., Town P.S. Case No. 22 of 2024.

5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case as well as the submission of the learned counsel for the petitioner, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge cum Special Judge, NDPS, Darbhanga/concerned Court below in connection with Town P.S. Case No. 70 of 2025 subject to conditions that:- (i).

The petitioner will mark his attendance at the Town Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner.

(ii) Before accepting the bail-bonds of the petitioner, the court below will verify the antecedent of the petitioner. If the petitioner is found having more criminal antecedents except Town P.S. Case No. 22 of 2024, then his bail bonds shall not be accepted. If the petitioner is found having one criminal antecedent i.e., Town P.S. Case No. 22 of 2024, then his bail bonds shall be accepted by the Court below.
