The petitioner seeks regular bail in connection with Piro PS case no. 30 of 2019 instituted for the offence punishable under Sections 399, 402, 414 of Indian Penal Code and 25(1-b)a, 26, 35 of Arms Act.

The allegation is regarding the police party having raided the place of occurrence, from where the accused persons including the petitioner were apprehended and it transpired that they were hatching a plan to commit dacoity. As far as the petitioner is concerned, one country made pistol and two live cartridges were recovered from him.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case

Patna High Court CR. MISC. No.42646 of 2019(3) dt.27-09-2019 2/2 only because of his poor antecedent and since, he is languishing in custody since 23.01.2019, he has been suitably punished. It is further submitted that though the petitioner is also accused in other criminal cases, however he is on bail in the said cases. Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur, Ara in connection with Piro PS case no. 30 of 2019.
