JUSTICE ARUN KUMAR ORAL ORDER 07-02-2017 Heard learned counsel for the petitioners and the State. Petitioners apprehend their arrest in connection with Dhaka P.S. Case No.197 of 2016 registered under sections 448, 341, 354, 324, 506, 323 and 307/34 of the Indian Penal Code. It is submitted that the false allegations are due to family disputes. Petitioner no. 1 and 2 are own brothers of the husband of the informant, both sides are agnates. On account of land dispute, petitioners have been falsely implicated in this case and the injuries are simple in nature and there is case and counter case, earlier case was lodged by Ram Pratap Sah and petitioners have no criminal antecedents.

Patna High Court Cr.Misc. No.44921 of 2016 (5) dt.07-02-2017 Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the court concerned, let the petitioners, namely, (1) Ram Pratap Sah; (2) Kailash Sah; (3) Chulia Devi; (4) Chameli Devi; and (5) Udmanti Devi be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M, Sikrahana Dhaka, East Champaran in connection with Dhaka P.S. Case No. 197 of 2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
