2. This application has been filed for modification of the order dated 12.05.2025 passed in Cr. Misc. No. 24113 of 2025 whereby this Court was pleased to grant anticipatory bail to the petitioner with a direction that he shall pay the alleged defalcated amount amounting to Rs. 8,34,632/- (Rupees eight lacs thirty-four thousand six hundred thirty-two only) in 4 equal installments amounting to Rs. 2,08,658/- (Rupees two lacs eight thousand six hundred fifty-eight) each within a period of six months from the date of furnishing bail-bond through demand draft in favour of the Financial Advisor and Chief Accounts

3. The present modification application has been filed on the ground that the Eastern Central Railways is not accepting the payment on the ground that there is no direction of this Court to the Office of the Eastern Central Railways for accepting the money and issuing receipt.
4. In view of reasons assigned in the petition and aforesaid submission of learned counsel appearing on behalf of the petitioner, let Paragraph No. 6 of the order dated 12.05.2025 passed in Cr. Misc. No. 24113 of 2025 be read as follows:- "6. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Railway, Barauni in connection with Bachhwara G.R.P.S. Case No. 63 of 2024, subject to conditions as laid down under Section 482(2) of the B.N.S.S., along with the following terms and conditions:
A. At the time of furnishing bail-bond Rs.
Rs. 2,08,658/- (Rupees two lacs eight thousand six hundred fifty-eight) shall be deposited through demand draft in the Nazarat of the Civil Court, Begusarai.
B. A receipt of payment of first installment
Patna High Court CR. MISC. No.45903 of 2025(2) dt.11-07-2025 3/3 shall be furnished at the time of furnishing bail bond.
C. Rest of the defalcated amount i.e. Rs.
6,25,974/- (Rupees six lacs twenty-five thousand nine hundred seventy-four) shall be deposited in the Nazarat of Civil Court, Begusarai in three equal installments of Rs. Rs. 2,08,658/- (Rupees two lacs eight thousand six hundred fifty-eight) each within a period of six months from the date of furnishing bail-bond.
D. The aforesaid payment shall be subject to the final outcome of the case.
E. If petitioner fails to comply the aforesaid direction of this Court, the Court below is free to cancel the bail-bond of the petitioner."
5. Accordingly, further six weeks' time from today is granted to the petitioner to surrender and furnish bail-bond before the concerned Court where the case is pending.
6. With the aforesaid directions, order dated 12.05.2025 passed in Cr. Misc. No. 24113 of 2025 is modified to the above extent and this modification petition is allowed. (Prabhat Kumar Singh, J) shashank/- U T
