The petitioner apprehends his arrest in connection with Forest Case No.13 of 2006 registered under Sections 41 and 42 of the Indian Forest Act.

The accusation is that on 21.11.2016, the Forest Officials received information through Officer Incharge Ghoshi about cutting of the green trees in village-Chiri Mauja near canal and carrying pieces of the wood. On receiving such information, the Forest Officials reached there and recovered the pieces of the wood from inside the road, near the saw mill of the petitioner. Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.5899 of 2017 (2) dt.28-03-2017 2/2 submits that, in fact, the petitioner and one Bipin Singh used to run the saw mill in the partnership near Sarthua Chowk and nearby the saw mill of the petitioner, there is also another saw mill. The petitioner has falsely been implicated in this case on mere suspicion. Further submission is that it would also appear from the seizure list that the pieces of the wood were not recovered from the saw mill of the petitioner rather the same were recovered from inside the road, near the saw mill of the petitioner. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad, in connection with Forest Case No.13 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
