JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-07-2019 Earlier prayer for bail of the petitioner was rejected twice by this Court, firstly vide order dated 9.11.2017 passed in Cr.Misc.No. 49791 of 2017 and secondly vide order 4.7.2018 passed in Cr.Misc.No. 39405 of 2018. Allegation against the petitioner and other accused persons is of assaulting the deceased by sharp cutting weapon and causing his death. Submission of learned counsel for the petitioner is that co-accused having similar allegation has been granted bail by a co-ordinate Bench of this Court vide order dated 7.5.2019 passed in Cr.Misc.No.12340 of 2019 and petitioner is in custody for about two years and no specific allegation has been attributed against him of assault.

Having heard both sides and in the facts and

No.42173 of 2019(2) dt.11-07-2019 2/2 circumstances, as stated above, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-IV, Gaya, in connection with Sessions Trial No. 98 of 2017/571 of 2017, arising out of Sherghatti P.S.Case No. 278 of 2017, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and petitioner has to cooperate in the disposal of trial and appear in court as and when required, otherwise his bail bonds shall be cancelled.
