Petitioner apprehends his arrest in connection with Tribeniganj P.S.Case No. 412 of 2017 registered for the offences punishable under Sections 420 and 409 of the Indian Penal Code. Allegation against the petitioner is that he has executed nine schemes of Rs.13,17,500/- and some irregularities were found.

Submission of learned counsel for the petitioner is that petitioner is the then Mukhiya of Gram Panchayat and he has executed whole schemes and no work was pending and he has produced all papers also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.37930 of 2018 (4) dt.06-08-2018 2/2 circumstances, let the petitioner, named above, surrender in the court below within a period of six weeks from the receipt of this order and on his so surrendering he shall be released on provisional bail till submission of charge sheet and in the meantime he will produce all the papers before the Investigating Officer, who will examine the same. However, if in spite of that charge sheet has been submitted and the case is found true against the petitioner, he has to surrender and make prayer for regular bail. With the above observation, this application is disposed of.
