JUSTICE SANJAY PRIYA ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Antichak P.S. Case No. 10 of 2016 initiated for the offence under Sections-307, 326A, 379 & other minor sections of the Indian Penal Code. There is specific allegation againt this petitioner of causing burn injury of acid on the face and eye of son of the informant. It is mentioned in the complaint petition itself that the informant was sent to Bhagalpur hospital for treatment, from where he was referred to PMCH for better treatment and when he returned on 01-02-2016, the informant went to the police station but the police did not register the case and thereafter, the instant complaint case was filed. In such circumstance, sufficient reason has been mentioned in the complaint for delay in filing this

Learned APP submits that witness in paragraph- 5 has fully supported the case.

There is direct and specific allegation against this petitioner of causing injury to son of informant by acid. In such circumstances, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail stands rejected.

The petitioner may surrender in the court below and make prayer for regular bail which will be disposed of on its merit without being prejudiced by this order.
