JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioners, and the learned counsel representing the State.
The petitioners apprehend their arrest in connection with Keoti P.S Case No. 60 of 2015 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 379, 307, 504 and 506 of the Indian Penal Code.
The learned counsel for the petitioners submits that due to some petty dispute the occurrence has taken place. Now good sense has prevailed between the parties and both parties have compromised the case and accordingly, compromise petition has been filed in the court of learned Sessions Judge in ABP No. 102/17, against the petitioner no. 2 there is only allegation that he snatched the
Patna High Court Cr.Misc. No.11331 of 2017 (2) dt.18-03-2017 amount which is super addition and against the petitioner no. 1 there is no allegation for committing any overt act and, as such, the petitioners deserve sympathetic consideration. The learned A.P.P. opposes the prayer of pre-arrest bail.
In the facts and circumstances stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of the order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Class, Judicial Magistrate, Darbhanga in connection with Keoti P.S. Case No. 60 of 2015 subject to the conditions as laid down in Section 438(2) of the Cr.P.C.
