JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 04-07-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Hathauri P.S. Case No. 143/2020 registered for offence punishable under sections 341, 447, 323, 324, 307, 379, 427, 504/34 of the Indian Penal Code and Section 27 of the Arms Act. As per allegation, six accused persons, including the petitioner, started dismantling the vehicle of the informant. The further allegation is that the petitioner inflicted farsa blow on the head of the informant.

The learned counsel for the petitioner has submitted that the present case was lodged on 1st of July, 2020, and prior to that

Patna High Court CR. MISC. No.56402 of 2021(2) dt.04-07-2022 2/2 case, the petitioner has lodged FIR on 25th of June, 2020 against the informant and other accused persons. The accused persons, including the informant, badly assaulted the petitioner and his son, who was treated in SKMCH. He has submitted further that injuries sustained by the informant, are simple in nature. Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur in connection with Hathauri P.S. Case No. 143/2020, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
