JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-10-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offences punishable under Sections 30(a), 37 of Bihar Prohibition and Excise Act, 2016.

As per prosecution case, 735 ml foreign liquor was recovered from bush near a tea stall below Chandralok bridge and it is alleged that the same liquor was purchased from this petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Nothing has been recovered from the conscious possession of the petitioner and in no way petitioner is connected with the recovery.

Patna High Court CR. MISC. No.45611 of 2022(2) dt.21-10-2022 2/2 Learned counsel for the State opposes the prayer for bail submitting that the petitioner has got 1 criminal antecedent of similar nature.

Considering the fact that petitioner has one criminal antecedent of similar nature, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
