Permission is accorded.
Accordingly, the prayer for anticipatory bail with regard to petitioner No.1 is withdrawn.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
This application, for grant of anticipatory bail, arises out of Trarai Police Station Case No. 78 of 2016, disclosing offences under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner has falsely been implicated in this case due to village

Though there is allegation of assault by means of lathi, danda and iron rod but there is no specific allegation against the petitioner. The petitioner is man of clean antecedent. Hence, the petitioner deserves the privilege of anticipatory bail. Learned A.P.P. for the State has opposed the prayer for bail of this petitioner and submitted that witnesses have supported the prosecution version, which is evident from paragraph nos. 6, 7, 8 and 16 of the case diary. Considering the facts and circumstances of the case, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of this petitioner s rejected.
