Petitioner seeks bail in Pasraha P.S. Case No.11 of 2019 instituted for the offence under Section(s) 25(1-b)a, 26 of the Arms Act.

Counsel for the petitioner submits that Petitioner is in custody since 20.01.2019.

It is alleged that one country made pistol and four live cartridges were recovered from possession of the petitioner. Counsel for the petitioner submits that there is no independent witness on the seizure list. Petitioner has been made accused only on suspicion because some other cases are also pending against the petitioner.

Keeping in view the period of custody, prayer of the

Patna High Court CR. MISC. No.42368 of 2019(2) dt.15-07-2019 2/2 petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Khagaria, in connection with Pasraha P.S. Case No.11 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
