The petitioner seeks bail in Bakhtiyarpur P.S. Case No. 265 of 2018, instituted for the offence under Section(s) 395 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused before the Police. He further submits that co-accused Ravikant Sharma @ Ravikant Kumar has already been granted bail by this Court vide order dated 2.7.2019 passed in Cr. Misc. 39089 of 2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna, in connection with Bakhtiyarpur P.S. Case No. 265 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
