JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,323,324,326,337,338,353,307,427,379 and 120B of the Indian Penal Code, section 27 of the Arms Act, sections 4/40 of Bihar Minor Mineral Concession Rules, 1972 and sections 3,41 and 42 of the Indian Forest Act.
It is alleged that the truck loaded with stone chips was intercepted and finding that it was being transported without valid authority, it was being taken to the police station when the mob attacked the informant, pelted stones and resorted to firing. The informant also fired from service revolver to disperse the crowd
Patna High Court Cr.Misc. No.35012 of 2015 (2) dt.19-08-2015 2/2 but the informant and other police personnel sustained injuries. It is submitted by the learned counsel for the petitioner that the FIR has been lodged against 52 named and 30-35 unknown. The accusation is omnibus and general. It is further submitted that the petitioner is a student and Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Rohtas in connection with Sasaram Mufassil) P.S. Case No. 595 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
