The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 342, 420, 354, 506, 376/511 and 323 of the Indian Penal Code. The prosecution case is that the petitioner being the brother-in-law of the informant confined the informant in a room and tried to ravish her.
It is submitted by learned counsel for the petitioner that for the occurrence of 01.04.2015 the FIR was lodged on 05.06.2015. Subsequently the father of the informant filed a petition before the SDPO, Sherghati to the effect that, in fact, the informant wanted to marry with the petitioner which
Patna High Court Cr.Misc. No.34270 of 2015 (2) dt.24-08-2015 2/2 was opposed by the family members including her father, hence, she lodged the present case. Subsequently the informant has retracted from the initial version and filed a petition to that effect before the learned court below.
Considering the delayed lodging of the case, the retracted version of the informant and the stand of the father of the informant, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Sherghati, Gaya in connection with Amas P.S. Case No. 91 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
